ANIMAL PLANET'S ROAR SWEEPSTAKES
OFFICIAL RULES
VOID WHERE PROHIBITED. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
OFFERED ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ("U.S."), AGED 18 YEARS OR OLDER.
1. ELIGIBILITY: Open to legal U.S. residents who are 18 years of age or older and have Internet access as of October 18, 2006. Employees, officers and directors of Discovery Communications, Inc. ("Sponsor"), its subsidiaries, affiliates, advertising agencies, promotional suppliers, Promotion Mechanics, Inc. ("Promotion Administrator") and the immediate family members (spouses, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of such employees, officers and directors (collectively, "Sweepstakes Entities") are not eligible. Subject to all applicable local, state, and federal laws. Void in Puerto Rico and where prohibited.
2. TO ENTER: Animal Planet's "Reach Out. Act. Respond" ("ROAR") Sweepstakes begins at 12:01 AM Eastern Time ("ET") on October 19, 2006 and ends at 11:59 PM ET on April 1, 2007. To enter, visit http://animal.discovery.com/sweepstakes/roar/2006/ and access the online entry form. Complete and submit the entry form so that it is received by Sponsor's server by 11:59 PM ET on April 1, 2007. Limit one entry per person per day.
3. RANDOM DRAWING - PRIZES - ODDS OF WINNING: On or about April 3, 2006, the Promotion Administrator, an independent judging organization, will conduct a random drawing from among all eligible entries received to award the following prizes:
One (1) Grand Prize: a trip for the winner and one guest to travel to and participate in a one or two week Earthwatch Expedition, up to a total value of $10,000 ($5,000 per person). Prize consists of round trip coach air travel for two people to the site of the expedition from a major commercial airport near winner's residence (as determined by Earthwatch); the expedition contribution, which includes expenses limited to the one to two week period you are in the field, including food, accommodation, on-site travel, medical and evacuation insurance; and all of the various costs of field research (field permits, equipment, etc.). Winner and guest must book their own flights and submit proof of payment for reimbursement. Winner and guest also must meet expedition eligibility requirements and consent to inherent risks for the expedition. Earthwatch reserves the right of final approval of all participants and expedition selection. Age restrictions apply to participants under the age of 18. Total retail value of Grand Prize may not exceed $10,000 (limited to a maximum of $5,000 per person). Expenses not specified are winners' responsibility. Volunteers do not have to have scientific knowledge or special skills (some exceptions, such as high rigor or SCUBA). Some restrictions and blackout dates do apply. Prize is not redeemable for cash, and winner must field within 12 months of date of award or prize will be forfeited in its entirety. Travelers are responsible for any travel insurance and for all trip expenses not specified.
One (1) First Prize: a one-week Emergency Vets internship for one person. Prize includes round trip coach air travel to the eVets location from a major commercial airport near winner's residence (as determined by Sponsor), accommodations for 7 days/6 nights, ground transportation and meals. Expenses not specified are winner's responsibility. Approximate retail value $3,000. Actual value will be determined by winner's residence and seasonal rates. Travel and accommodations are subject to availability and certain restrictions. Internship must be taken at a time to be determined by the Sponsor or winner will forfeit the prize in its entirety.
Winners will be requested to keep an e-diary documenting his/her experience in text and digital photos and to grant Sponsor the results and proceeds of the e-diary hereunder (the "Materials") with the right for the full period of copyright, including all extensions and renewals thereof, and thereafter in perpetuity, throughout the world, to use and re-use all or any part of the Materials for the purpose of making and producing television programs and other works, and advertising, publicizing and exploiting the same, by all means and in all media, whether now known or hereafter devised, and to authorize others to do so. Neither winner nor other party now or hereafter having an interest in the e-diary shall have any right or action against the Sponsor or any other party arising out of any use of said Materials. Winner further agrees that Sponsor may elect, in its sole discretion, to not use the winner's e-diary or to use only a portion of the e-diary.
Winners will be notified by email, phone, postal mail and/or express mail at Sponsor's sole discretion. Inability to contact a winner or the return of any prize notification as undeliverable will result in the prize being forfeited and awarded to an alternate winner selected at random from the remaining eligible entries. Odds of winning will be determined by the number of eligible entries received.
4. GENERAL: Taxes on prizes and all expenses related to acceptance and use of prizes and not specified are the sole responsibility of winners. By participating, entrants agree [a] to these rules and decisions of Sponsor and Promotion Administrator, which shall be final in all respects relating to this sweepstakes; [b] to release, discharge and hold harmless Sweepstakes Entities from any and all injuries, liability, losses and damages of any kind resulting from their participation in the sweepstakes or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage; and if a winner, [c] to permit Sweepstakes Entities to use his or her name, photograph, likeness, statements, biographical information, voice, voice likeness, city and state address, and the photograph and/or video of entrant's room for advertising, publicity and promotional purposes in all media, including but not limited to on air and within www.discovery.com, in perpetuity, without further notice or compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Potential winners will be required to complete an affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within time period specified in notification letter or an alternate winner may be selected. If a winner is 18 or older, as is required for entry, but not of the age of majority in state of residence, prize will either be awarded in the name of parent or legal guardian, or parent or legal guardian must ratify and sign any and all documents required of winner. Grand Prize winner's guest, or a parent or legal guardian if travel companion is a minor, must complete a liability/publicity release prior to issuance of travel documents. By accepting a prize, the winner and his/her guest represent that they understand that travel, whether by plane, automobile, or other conveyance, or by foot, and in the air, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, or other agencies, known or unknown. Each winner and his/her guest represent that they recognize that such risks may be present at any time before, during and after the trip. In order to be considered a winner and partake of the enjoyment of the prize trip, each winner and his/her guest must be willing to accept the risk, and to confirm their acceptance to such risk in writing at Sponsor's request. Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective officers, directors and employees are not responsible for and shall not be liable for [a] any telecast, cable or telephone malfunctions, human error, satellite transmission failures, or delayed telecasts or preemption of or the failure of a cable affiliate to televise Animal Planet® or any affiliated Sponsor network in all or any parts of the United States; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [c] failed, incomplete, garbled or delayed computer transmissions; [d] late, lost, misdirected or incomplete entries or postage-due mail; or [e] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right to cancel or suspend the sweepstakes or any portion thereof should virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the promotion, in which case prizes will be awarded via a random drawing from among all eligible entries received prior to cancellation. Entry information becomes property of Sponsor. No prize transfer or cash redemption. No prize substitution, in whole or in part, except by Sponsor due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor in which case a prize of comparable or greater value will be awarded. Internet entry must be made by the entrant only at the authorized web site address of www.animalplanet.com. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites. Any winner who enters by any of the methods described above will be disqualified and an alternate winner selected. Use of any device to automate entry is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules. This sweepstakes is governed by the laws of the State of Maryland, with jurisdiction and venue in Montgomery County, Maryland, and all claims must be resolved in the courts of Montgomery County, Maryland.
5. ENTRY INFORMATION: Please note that by entering this sweepstakes and by checking the "opt-in" boxes on the entry form for this promotion, you are [a] agreeing that the Sponsor may share your entry information (including your name, address, email address, etc.) with our promotional partners and other parties; and [b] granting us, our promotional partners and other third parties with which we choose to share your information, permission to contact you about our upcoming shows, promotions or for other reasons. You may enter this sweepstakes but keep your entry information private by not checking the "opt-in" boxes on the entry form. The collection and use of entrant information will be governed by Sponsor's on-line privacy policy, available for viewing at http://animal.discovery.com/utilities/about/privacypolicy.html.
6. WINNER LIST: To receive a list of winners, mail a self-addressed, stamped envelope to be received by April 30, 2007 to: Animal Planet's ROAR Sweepstakes Winners, PMI Station, PO Box 750, Southbury, CT 06488-0750.
