OFFERED ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ("U.S."), AGED 18 YEARS OR OLDER.
1. ELIGIBILITY: Open to legal U.S. residents who are 18 years of age or older at time of entry. Employees, officers and directors of Discovery Communications, Inc. ("Sponsor"), its promotional partner Howard Johnson International, Inc., Promotion Mechanics, Inc. ("Promotion Administrator"), Universal Studios Theme Parks, their parent companies, subsidiaries, affiliates, TV production partners, advertising agencies, promotional suppliers and the immediate family members (spouses and parents, children and siblings and their spouses, regardless of where they live) or members of the same households (whether related or not) of such employees, officers and directors (collectively, "Sweepstakes Entities") are not eligible. All applicable federal, state, and local rules apply. Void in Puerto Rico and where prohibited or restricted by law.
2. TO ENTER: The Howard Johnson Animal Planet Safari Sweepstakes ("Sweepstakes") begins at 12:01 am Eastern Time ("ET") on May 3, 2004 and ends at 11:59 pm on June 6, 2004. To enter, visit www.discovery.com and click on the Animal Planet logo. Once at the Animal Planet page, click on the Howard Johnson Animal Planet Safari Sweepstakes button to access the sweepstakes entry page. If you are not a My Discovery member, you will be asked to complete a one-time registration form and become a member on your first visit. If you are already a member of My Discovery and are logged in, just hit enter to automatically submit your information. Complete the online entry form and submit so that it is received by Sponsor's server by 11:59 PM ET on June 6, 2004. Limit one entry per person per day. By entering, participants warrant and represent that they agree to be bound by these Official Rules and the final decision of the Sponsor and Promotion Administrator.
3. RANDOM DRAWING - PRIZE - ODDS OF WINNING: On or about June 8, 2004, Promotion Mechanics, Inc., an independent judging organization, will conduct a random drawing from among all eligible entries received to award (1) Grand Prize: a trip for four to Universal Orlando® Resort. The prize consists of the following:
- round trip, coach class air transportation from the major airport closest to winner's home to Orlando, FL;
- hotel accommodations, room and tax only, for up to four (4) people in a maximum of two (2) rooms at the Howard Johnson hotel in Orlando, for five (5) nights (does not include meals, incidentals, tips, telephone calls, or any other personal expenses incurred);
- backstage access to Animal Planet Live!;
- an Exclusive VIP tour of either Universal Studios Florida or Islands of Adventure (choice TBD by winner);
- 4-day studio passes for four (4) people for admission to Universal Studios Florida and/or Universal's Islands of Adventure; and
- use of a rental car for duration of stay (subject to all car rental agency qualifications and restrictions).
All other expenses not specified are winner's responsibility. Approximate retail value $6,800. Actual value will be determined by winner's residence and seasonal rates. Winner or winner's guest must be 25 years of age or older and must have a valid U.S. driver's license in his/her state of residency, appropriate motor vehicle insurance, and a major credit card to secure the rental car. Optional services or items such as refueling or loss or damage waiver (LDW) are extra. Travel and accommodations are subject to availability and certain restrictions; blackout dates may apply. Winner travel arrangements must be made a minimum of 60 days prior to travel. Winner and guests must travel at the same time and must depart from the same city. Trip must be taken by June 1, 2005 or prize will be forfeited in its entirety. Travelers are responsible for any travel insurance and for all trip expenses not specified.
Winner will be notified by email, phone, postal mail and/or express mail at Sponsor's sole discretion. If a potential winner fails to respond within 10 days of Sponsor's notification attempt, the prize will be forfeited and an alternate winner will be selected at random from the remaining eligible entries. Odds of winning will be determined by the number of eligible entries received.
4. GENERAL: Taxes on prize and all expenses related to acceptance and use of prize and not specified are the sole responsibility of winner. By participating, entrants agree [a] to these rules and decisions of Sponsor and Promotion Administrator, which shall be final in all respects relating to this sweepstakes; [b] to release, discharge and hold harmless Sweepstakes Entities from any and all injuries, liability, losses and damages of any kind resulting from their participation in the sweepstakes or their acceptance, use or misuse of prize including, without limitation, personal injury, death and property damage; and if a winner, [c] to permit Sweepstakes Entities to use his or her name, photograph, likeness, statements, biographical information, voice, voice likeness and city and state address for advertising, publicity and promotional purposes in all media, including but not limited to on air and within www.discovery.com, in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Winner will be required to complete an affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within time period specified in notification letter or an alternate winner may be selected. If winner is 18 or older, as is required for entry, but not of the age of majority in state of residence, prize will either be awarded in the name of parent or legal guardian, or parent or legal guardian must ratify and sign any and all documents required of winner. Grand Prize winner's travel companions (or if a minor, a parent/legal guardian) must complete a liability/publicity release prior to issuance of travel documents. By accepting the Grand Prize, the winner and his/her travel companions represent that they understand that travel, whether by plane, automobile, or other conveyance, or by foot, and in the air, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, or other agencies, known or unknown. Grand Prize winner and his/her travel companions represent that they recognize that such risks may be present at any time before, during and after the trip. In order to be considered a Grand Prize winner and partake of the enjoyment of this trip, Grand Prize winner, his/her travel companions must be willing to accept the risk, and to confirm their acceptance to such risk in writing at Sponsor's request. Sponsor, Howard Johnson International, Inc., their respective affiliates, subsidiaries, advertising and promotion agencies, agents and representatives, Promotion Administrator, and the officers, directors and employees of each are not responsible for and shall not be liable for [a] any telecast, cable or telephone malfunctions, human error, satellite transmission failures, or delayed telecasts or preemption of or the failure of a cable affiliate to televise Animal Planet® or any affiliated Sponsor network in all or any parts of the United States; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [c] failed, incomplete, garbled or delayed computer transmissions; [d] late, lost, misdirected or incomplete entries or postage-due mail; or [e] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right to cancel or suspend the sweepstakes or any portion thereof should virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the promotion, in which case prize will be awarded via a random drawing from among all eligible entries received prior to cancellation. Entry information becomes property of Sponsor. No prize transfer or cash redemption. No prize substitution, in whole or in part, except by Sponsor and/or its promotional partner due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor in which case a prize of comparable or greater value will be awarded. Internet entry must be made by the entrant only at the authorized web site address of www.discovery.com. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites. Any winner who enters by any of the methods described above will be disqualified and an alternate winner selected. Use of any device to automate entry is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules. This sweepstakes is governed by the laws of the State of Maryland, with jurisdiction and venue in Montgomery County, Maryland, and all claims must be resolved in the courts of Montgomery County, Maryland.
5. ENTRY INFORMATION: Please note that by entering this sweepstakes and by checking the "opt-in" boxes on the entry form for this promotion or on the My Discovery website, you are [a] agreeing that the Sponsor may share your entry information (including your name, address, email address, etc.) with our promotional partners and other parties; and [b] granting us, our promotional partners and other third parties with which we choose to share your information, permission to contact you about our upcoming shows, promotions or for other reasons.
6. WINNER LIST: To receive winner's name, mail a self-addressed, stamped envelope to be received by June 30, 2004 to: Howard Johnson Animal Planet Safari Sweepstakes Winner, PMI Station, PO Box 750, Southbury, CT 06488-0750.
